Terms of Use and Service

Haverhill Design designs, delivers, and installs seasonal decorative displays, including pumpkin and autumn porch displays, at residential and commercial properties in the metropolitan Atlanta, Georgia area.

You must be at least 18 years of age and able to form a binding contract to place an order. By placing an order, you represent that you meet these requirements and that all information you provide is accurate and complete.

You further represent that you are the owner or lawful occupant of the property where services are to be performed, or that you have permission from the owner or occupant to authorize our work at that property.

We may update these Terms from time to time. The version posted on our website at the time you place an order governs that order. Changes take effect when posted, and the “Effective Date” above will be updated. Your continued use of the website after changes are posted constitutes acceptance of the revised Terms.

When you submit a booking through our website, you are making an offer to purchase the selected package, add-ons, and installation date. Your order is not accepted until we send a confirmation identifying your installation date.

Installation dates are subject to availability and route capacity. We may propose an alternative date if your requested date is unavailable. If we cannot accommodate you, we will notify you and refund any amount charged.

We reserve the right to limit quantities, decline or cancel an order, or discontinue any package at any time, including where a listing contained an error in price, description, or availability.

Prices are stated in U.S. dollars and are subject to change until your order is accepted. Packages are paid in full at the time of booking unless we agree otherwise in writing.

Payments are processed by our third-party payment processor. We do not receive or store your full payment card number. Financing or installment options, where offered, are provided by a third-party lender under that lender's separate terms, and approval is determined solely by the lender.

You are responsible for all applicable sales, use, and other taxes, which will be added where required by law. Promotional codes and discounts may not be combined unless expressly stated and have no cash value.

We deliver and install only within our published service area. Installation windows are estimates, not guaranteed times. We will make reasonable efforts to notify you of material delays.

You do not need to be present, but you must provide safe, unobstructed access to the installation area, including any gate codes, parking instructions, or building access we request. You are responsible for securing pets and for informing us of any conditions that affect safe access.

If we cannot access the property, or if the site is unsafe or unsuitable for installation, we may attempt delivery at a later date or complete the installation at the nearest suitable location. Additional trips may incur a fee.

You are responsible for obtaining any approvals required by a homeowners association, landlord, or local ordinance before we install. We are not responsible for fines, removal demands, or costs arising from a lack of such approval.

Pumpkins, gourds, hay, straw, mums, and similar materials are natural agricultural products. Size, color, shape, surface texture, and stem condition vary from item to item and from season to season.

Photographs, illustrations, and item counts on our website are representative and are not a guarantee of the exact appearance of your display. Where an item is unavailable, we may substitute an item of comparable type, size, and value.

Natural materials are perishable. Their appearance and longevity depend on weather, sun exposure, temperature, humidity, handling, wildlife, insects, and other conditions outside our control. We do not guarantee that any item will remain in a particular condition for any period of time.

Care guidance we provide is offered as a courtesy and is not a warranty. Damage, decay, theft, vandalism, animal activity, or displacement occurring after installation is not covered unless stated in a separate written warranty.

Severe weather may require us to reschedule an installation. If we reschedule, we will contact you to arrange the next available date.

Requests to change or cancel an order must be sent to info@haverhilldesign.com and are effective only when we confirm them. All sales are final and refunds can only be granted at the discretion of Haverhill Design.

We may cancel an order and issue a refund where we cannot safely or lawfully perform the work, where the property is outside our service area, where materials become unavailable, or in any other scenario that prevents the work.

End-of-season removal is available as a paid add-on where offered. Removal includes collection and disposal or composting of the materials we installed. We are not responsible for removing items we did not supply.

If removal is not purchased, you are responsible for disposal of all materials after the season.

Decorative materials are heavy and are placed on surfaces including porches, steps, walkways, and landscaping. Moisture, weight, and prolonged contact can mark or stain some surfaces, including painted wood, stone, brick, pavers, and turf.

By authorizing installation, you accept this risk and agree that we are not responsible for staining, discoloration, indentation, or ordinary wear to surfaces arising from the presence of the display, absent our gross negligence or willful misconduct.

Please tell us before installation about any fragile, historic, or recently treated surfaces, and about irrigation lines, lighting, or other buried or concealed installations near the work area.

We may photograph or record completed installations for portfolio, social media, advertising, and quality purposes. We will not publish your street address, house number, or name in connection with such images.

You may opt out of marketing use of images of your property at any time by writing to info@haverhilldesign.com. Opting out does not affect images already published in printed materials or third-party platforms where removal is not feasible.

If you purchase services for delivery to a third party, you are responsible for the accuracy of the recipient's address and for confirming that the recipient consents to installation at that property.

The website and its contents, including text, photographs, illustrations, designs, logos, and the selection and arrangement of that content, are owned by Haverhill Design or its licensors and are protected by copyright, trademark, and other laws.

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the website for your personal, non-commercial purposes. You may not copy, reproduce, republish, scrape, or create derivative works from our content without our prior written permission.

If you submit photographs, reviews, comments, or other content to us, you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, adapt, publish, and display that content in connection with our business.

You represent that you own or have the right to submit the content, that it is accurate, and that it does not infringe the rights of any third party. We may remove content at our discretion.

You agree not to use the website to submit false or fraudulent orders; to interfere with or disrupt the website or its security features; to access data not intended for you; to use automated means to collect information from the website; or to use the website in violation of any applicable law.

The website may link to or rely on third-party services, including payment processing, financing, mapping, analytics, and social media platforms. We are not responsible for the content, policies, or practices of third parties, and your use of their services is governed by their terms.

EXCEPT AS EXPRESSLY STATED IN THESE TERMS, THE WEBSITE AND OUR SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT NATURAL MATERIALS WILL REMAIN FREE OF DECAY, PESTS, OR DAMAGE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAVERHILL DESIGN WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, ARISING OUT OF OR RELATING TO THE WEBSITE, OUR SERVICES, OR THESE TERMS.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO AN ORDER WILL NOT EXCEED THE AMOUNT YOU PAID FOR THAT ORDER.

NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR BODILY INJURY CAUSED BY OUR NEGLIGENCE.

You agree to indemnify and hold harmless Haverhill Design and its owners, employees, and contractors from claims, damages, and expenses, including reasonable attorneys' fees, arising out of your breach of these Terms, your violation of law, or your failure to obtain approvals required for installation at your property.

We are not liable for delay or failure to perform caused by events beyond our reasonable control, including severe weather, crop failure or supply shortage, fire, flood, labor disruption, utility or transportation failure, epidemic, or government action.

These Terms and any dispute arising out of them are governed by the laws of the State of Georgia, without regard to its conflict of laws rules. Subject to any dispute resolution provision above, you and Haverhill Design consent to the exclusive jurisdiction and venue of the state and federal courts located in Fulton County, Georgia.

By placing an order, you consent to receive communications from us electronically, including order confirmations, scheduling notices, and service messages sent by email or text message to the contact information you provide. These transactional messages are not marketing messages.

If you opt in to marketing messages, message and data rates may apply, message frequency varies, and you may opt out at any time by replying STOP or by following the unsubscribe instructions in the message.

If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign your rights under these Terms without our consent; we may assign ours in connection with a sale or reorganization of the business.

These Terms, together with any order confirmation and our Privacy Policy, are the entire agreement between you and Haverhill Design regarding their subject matter.
